Terms of Service

1. Who can use FiveNine

You must be at least 18 years old to create an account, buy Digital Access Passes or Gifting Credits, send gifts or message models. You must give accurate information and keep one account per person. FiveNine is not offered where its use is prohibited by law, and you may not use FiveNine if you are located in, or are a resident of, a country or region subject to U.S. sanctions, or are on a U.S. government restricted-party list.

2. Your account

You are responsible for activity on your account and for keeping your sign-in details secure. Tell us right away through the Support form if you think your account has been misused. We may suspend or close accounts that break these Terms.

3. Payments

• Payment methods. You can pay by card, in SOL (Solana) from a compatible wallet, or with platform credits where available. The methods shown at checkout are the ones currently available.
• Prices. Prices are shown in U.S. dollars or in SOL with an approximate U.S. dollar value. Card payments are charged in U.S. dollars. For SOL payments, the SOL amount is fixed when you confirm the transaction, and the payment is final once confirmed on the blockchain.
• Taxes and fees. Prices may be subject to taxes and payment fees, which are shown before you pay.
• Orders. We may refuse or cancel an order that we reasonably believe is fraudulent or breaks these Terms. If we cancel an order, we refund any amount you paid.

4. Gifting Credits

• What they are. Gifting Credits are platform credits you buy to send virtual gifts through eligible FiveNine features, such as live streams and messages.
• No cash value. Gifting Credits cannot be exchanged for cash or cryptocurrency, transferred to another account or resold. They are not an investment and earn no return.
• Gifts are final. Once a gift is sent, it cannot be withdrawn or refunded. A gift does not buy any service, content, meeting, personal attention or relationship, and does not entitle you to a response.
• Expiry. Gifting Credits do not expire while your account is open. If you close your account, or it is closed for breach of these Terms, unused credits are forfeited, except where the law requires a refund.
• Models. Models receive a share of the gifts they receive under their separate agreements with FiveNine.
• Limits and misuse. We may set purchase and gifting limits, monitor transactions for fraud and money laundering, and ask you to verify your identity or payment method. We may remove credits obtained through fraud, chargebacks or errors, suspend or close accounts involved in misuse, and report unlawful activity to the authorities.

5. All sales are final

No refunds

All sales on FiveNine are final. This includes Gifting Credits, live-stream access, paid messages and Digital Access Passes. Purchases are not refundable and Gifting Credits cannot be exchanged for cash, except where required by applicable law.

Billing errors and unauthorized charges

If you believe you were charged in error or without your authorization, contact Support through the form at 59integrity.com promptly so we can investigate. A chargeback on a delivered purchase may lead to the related benefits or account being suspended while it is reviewed.

App store purchases

Purchases made through Apple, Google or another app store are also subject to that store’s terms.

Your legal rights

Nothing in these Terms affects any rights you have under applicable consumer-protection law.

6. Community rules

All interactions on FiveNine must be respectful and suitable for a mainstream audience. This covers live streams, messages, gifts and comments. You must not:

• post or request sexual or explicit content;
• harass, threaten or demean models or other users;
• impersonate anyone;
• send spam;
• ask a model for payment or contact outside the platform;
• use FiveNine for anything unlawful.

Models may block users. We moderate content, may remove anything that breaks these rules, and may suspend or close accounts.

7. Not an investment

Digital Access Passes and Gifting Credits are designed as digital access and engagement products. They are not intended as investments, and you should not buy them expecting a profit or a return. FiveNine does not offer, sell or accept investments through this website, the Digital Access Pass store, or any chatbot or AI assistant.

8. Content and likeness

• Ownership. Content on FiveNine belongs to FiveNine or the models.
• Restrictions. You may not copy, record, redistribute or sell content from FiveNine. You may not use any model’s name, image or likeness, including to train AI systems or to create AI-generated content.
• License. Your Digital Access Pass gives you a personal license to access the content linked to it, not ownership of that content.
• Copyright complaints. If you believe content on FiveNine infringes your copyright, contact us through the Support form with the details required by law, and we will review it.

9. Privacy

Our Privacy Policy explains how we collect, use and protect your personal information. By using FiveNine you agree to it.

10. Suspension and termination

• By us. We may suspend or end your access for breaches of these Terms, fraud or legal reasons. When it is safe and lawful to do so, we will tell you why.
• By you. You can close your account at any time through the Support form.

11. Disclaimers and limitation of liability

FiveNine is provided “as is” and “as available.” To the fullest extent permitted by law, we are not responsible for:

• losses caused by blockchain networks, wallets, marketplaces or other services we do not control;
• interruptions to the service or loss of data;
• indirect, incidental, special or consequential losses.

Our total liability to you for any claim relating to FiveNine is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits any rights or liability that cannot be limited by law.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, give you reasonable notice. If you keep using FiveNine after the changes take effect, you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in the State of Delaware.
